Are you sure that your independent contractor isn't your employee?

If you've issued them a 1099 Form instead of a W2 they may still be your employee

If you misclassify an employee as an independent contractor, the first offense could cost you $25,000 or you could spend up to 30 days in jail.

Your second offense could cost you an additional $50,000 and up to 60 days imprisonment. 

Calling an employee an Independent Contractor to skirt the rules will get you found out by the authorities.

These days there is too much information out there on your organization to risk the misclassification to save a few dollars.
